Practical experience of conducting mediation or conciliation or judicial settlement conferences or out-of-court dispute settlements in disputes related to the scope of competence of the PMAC

Experienced European Patent Attorney and ex-accredited mediator for civil and commercial disputes, with a demonstrated 6-year membership of the ADR Committee of the Italian Industrial Property Consultant Institute, promoting ADR in IP and patent-related disputes.

• More than 8 years (2011-2019) in conducting conciliation attempts via facilitative mediation techniques in civil disputes, acting as Expert of the Court (Italy), unfortunately not in IP.
• IP rights Scope of practice: As Expert of the Court, in three IP dispute cases, one design infringement action and two patent infringement/counterclaim for revocation actions (European Patents validated in Italy), I conducted a conciliation attempt, using facilitative mediation techniques.
• It has unfortunately not been possible to practice formally as a mediator in patent cases. Nevertheless, mediation techniques were consistently applied while serving as Expert of the Court during civil and intellectual property litigation, with the objective of facilitating conciliation and amicable settlement of disputes.
