Professional biography
Simon Klopschinski has been a patent litigator for over 15 years dealing in particular with cases in the fields of pharma, life science, and medical devices. He has represented clients before German courts and the UPC. Since 2024 Simon is a partner at rospatt Rechtsanwälte PartG mbB which is one of the most renowned patent litigation firms in Germany and Europe. Simon's work is recognized by directories such as IP Stars and IAM Patent 1000. In addition to his extensive litigation practice, Simon has served as counsel in arbitrations dealing with patents, contract matters and designs. Simon studied law at the universities of Konstanz (Germany) and Cardiff (UK) and obtained his PhD under the supervision of Professor Joseph Straus at the Max Planck Institute for Intellectual Property, Competition and Tax Law in Munich. For his PhD thesis on the protection of intellectual property rights under international investment law which is a special field of arbitration, he was awarded with the Otto Hahn Medal of the Max Planck Society and the Award of the Law Faculty of the Ludwig Maximilian University in Munich. In the last 20 years Simon has extensively published on patent law and the intersection of intellectual property rights and arbitral proceedings. Together with Professor Mary-Rose McGuire (University of Osnabrück) he co-edited the Edward Elgar Research Handbook on Intellectual Property Rights and Arbitration (2024). In 2020 Simon published together with Professor Christoper S. Gibson (Suffolk University Law School) and Professor Henning Grosse Ruse-Khan (Cambridge University) the treatise “The Protection of Intellectual Property Rights Under International Investment Law” with Oxford University Press. Due to his publications on international investment law, Simon is not only an expert in arbitration but he has also acquired a deep understanding of public international law which is crucial in the UPC context since the UPC Agreement is a treaty governed by international law.
